This incident happened on 16/12/2020 around 8 pm at Amadesa Resort Condominium, Jalan 5/125, Taman Desa Petaling, 57000 KL.
As I was driving home towards Amadesa Resort Condominium’s car park, a dark blue Mercedes Benz was obstructing the traffic toward the car park entrance. I waited for a few mins before I started to honk and the car finally moved so I may park my car in my lot.
After locking my car, I walked towards the staircase leading to the lobby, this uncle in his 50s walked towards me and confronted me, asking if I’m the one who honked? I admitted yes because I had waited a long time. Upon my reply, he was furious. Without warning, he grabbed my hair and continuously punched me on the head and face.
I was terrified and ran behind a car to hide as I was alone and defenseless. I was much smaller in size and strength compared to him who is more than a foot taller than me. I called my dad to come down and save me. Whilst I was making the call, the attacker walked away to his home as if nothing had happened.
I am unsure if I considered myself lucky because one of the residences saw the incident who also happened to know the owner of the vehicle.
Due to the beating, my mouth and gums were bleeding badly as I’m on braces. The impact of those punches on my head gave me a massive headache and swells, I am worried that I may suffer from a concussion from those beating.
My dad immediately rushed down to the scene. I told my dad the whole incident and I called 999 police for help. While waiting for the police to arrive, the guard managed to bring the attacker down to the carpark. The attacker came down with a chopping knife hide behind his back (an eyewitness managed to take a picture) along with his two sons.
My dad asked why did he hit me? He shouted back at my dad, quoting, “She deserves the beating/punching because she honks at him.”. He tried to assault again before his sons held him back. He threw/hid the chopping knife away the moment he saw the police arrive. The policemen arrested him arrested and took him to the Salak Selatan Baru Police Station while my dad drove me there to file a report. After making the report, we had to go to Cheras District Police Headquarters (IPD Cheras Maluri) to have a statement with Sarjan khairizam.
Sarjan Khairizam mentioned that once the case is handed over to the police, it will be based on the judgment of the court. As he did not use any weapon, he can only be charged with assault. If he is charged under section 323 of the Penal Code, he will receive a maximum of 1 year imprisonment, or maximum RM 2,000 fine, or both depending on the court’s decision.
As he is some kind of Dato’ according to the “Dato’ badge” on his car plate, I’m afraid he will easily getaway as the fine are mere small money to him compared to a civilian like me who suffered bodily injuries.
Sarjan Khairizam requested me to go to HUKM to get a body examination report at my own cost of RM50. At the hospital, the doctor injected a painkiller to ease my pain. I was sent for a head x-tray to ensure there is no concussion. After the check-up, I had to send this document back to Sarjan Khairizam at the police station.
This nightmare ended at 2 am plus after all the documents were submitted. Upon returning home, I was told by my mom that the sons of the attacker apologize and ask to not to press charges because the father was STRESSED… Does that mean that anyone is allowed to treat others as a punching bag if he was stressed? What if the police didn’t arrive on time? What would he have done with the chopping knife which he hid behind his waist? Was he going to chop me into pieces because he was STRESSED? If I lost my life, does that mean an apology from the sons accommodates the loss of my parents for my death?
According to FMT, the stressed uncle who assaulted a 27-year-old woman for honking at him has been fined RM2,000.
In a statement, Cheras police chief Mokhsein Mohamed Zon said the 58-year-old man, who runs a restaurant, had pleaded guilty to voluntarily causing hurt, an offense under Section 323 of the Penal Code.
“The case is believed to have stemmed from a misunderstanding between the victim and the man. The man was arrested on the same day and charged in court yesterday (Dec 17),” said Mokhsein.
